1. Scope and provider
These terms govern the use of Book-Sharing (book-sharing.de and book-sharing.net). The provider is Christopher Frühwirth; the full provider details are in the imprint. By creating an account or using the service you accept these terms.
2. What Book-Sharing does – and what it does not
Book-Sharing is a free platform where members manage their own book collection, keep a reading journal and offer books to other members for swapping or giving away.
Book-Sharing is a platform only. Any swap, gift or other agreement is concluded exclusively between the members involved. We are not a party to that agreement, we are not a seller, buyer or intermediary, and we do not check books, condition descriptions or shipments.
The service is provided free of charge. There is no claim to permanent availability; functions may be changed or discontinued.
3. Account and minimum age
You need an account to offer books and to message other members. You must be at least 16 years old; if you are younger, you need the consent of a parent or guardian. Provide accurate details, keep your password secret and do not pass your account to anyone else. One person may not run several accounts in order to circumvent rules or gain tokens.
4. Rules for content
You are responsible for everything you publish: book entries, offer descriptions, reviews, notes, profile details and messages. Do not post content that is unlawful, discriminatory, insulting, threatening, obscene or infringing. Do not post spam, chain letters, pyramid schemes or advertising unrelated to your own books, and do not upload copyrighted works you have no rights to. Do not publish other people's personal data.
5. Rights to content you submit
Your content remains yours. You grant us a simple, non-exclusive, free right to display and distribute it on the platform to the extent needed to operate the service (for example showing your offer on the swap page). This right ends when you delete the content, except where it is still needed to document a completed swap.
6. Swapping between members, shipping and condition
Describe the condition of your books honestly. Agree on shipping or handover directly with the other member. Risk and costs of shipping are a matter between the members involved; we do not provide shipping, insurance or escrow. If a shipment is lost or a book does not match its description, please settle it with the other member; we can only help with mediation.
7. Tokens
Tokens are internal community points that keep swapping fair. They are not money: they cannot be paid out, sold or exchanged for money, and they do not create a claim to a permanently available service. Tokens are booked when a swap request is accepted. Do not collect tokens as a store of value – they exist to be used. We may correct token balances in cases of abuse or technical errors.
8. Reporting and moderation
If content breaks these rules or infringes your rights, report it to us (contact details in the imprint). We review reports within a reasonable time and may remove content or restrict accounts. Because this is a manual process, it may not happen immediately. If you disagree with a decision, contact us – we will look at it again.
9. Liability
We are fully liable for intent and gross negligence, and for injury to life, body or health. For slight negligence we are only liable where an essential contractual obligation is breached, and then limited to typical, foreseeable damage. We are not liable for content created by members, for agreements between members, or for the accuracy of book data supplied by third-party sources.
10. Suspension and termination
You can delete your account at any time. We may restrict or close accounts if these terms are breached, in cases of abuse or security problems, if legal requirements demand it, or if the service is discontinued. Where reasonable, we will inform you beforehand.
11. Changes to these terms
We may adjust these terms, for example when functions change or legal requirements change. You will be informed about significant changes in good time. If you continue using the service after that, the updated version applies.
12. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
